US EPA Releases List of Expiring TSCA Confidential Business Information Claims

On April 24, 2026, the U.S. Environmental Protection Agency (EPA) officially released a publicly accessible list identifying confidential business information (CBI) claims that are set to expire automatically under the Toxic Substances Control Act (TSCA).

The published list covers CBI claims expiring between June 22, 2026, and July 31, 2026. To ensure accuracy and timeliness, EPA plans to update the list on a monthly basis as these claims approach their expiration dates. The Agency strongly urges all regulated entities to immediately review the list carefully and verify whether their submitted CBI claims are included.

Under TSCA regulations, if companies wish to extend the protection period of their CBI claims, they must submit an electronic application through EPA's Central Data Exchange (CDX) no later than 30 days prior to the claim's expiration date. Applicants must simultaneously submit adequate substantiation demonstrating why continued protection of the information remains necessary.

To streamline the process, EPA has launched a new dedicated tool on the CDX platform for "TSCA Section 14(e) CBI Claim Extension Applications" to uniformly receive and process such requests. The Agency particularly emphasizes that if an extension application is not received by the deadline, EPA will have no obligation to continue maintaining the confidentiality of the relevant information, and such information may be disclosed without further notice to the original submitter.

EPA indicates that future communications on this matter, including potential webinar announcements, will also be released through this webpage. Companies should closely monitor updates to this page to obtain the latest developments and guidance.
