Global Compliance Perspective on HMOs: Approvals and Applications in the US

Human Milk Oligosaccharides (HMOs) are unique components found exclusively in human breast milk. They are the third most abundant solid component in human milk and exhibit a variety of biological functions, including modulation of gut microbiota and support of cognitive development.

There are more than 200 types of HMOs, each with specific structures and functions, enabling applications across different fields. As a result, regulatory submissions for HMOs are rapidly increasing worldwide, with commercialization first initiated in Europe and the United States.

In 2015, the U.S. Food and Drug Administration (FDA) recognized the first HMO – chemically synthesized 2’-fucosyllactose (2’-FL) submitted by Glycom A/S – as Generally Recognized as Safe (GRAS).

Since then, multiple HMOs have successively obtained GRAS status in the United States. Details are summarized below.

2’-FL

As the earliest approved HMO in the U.S., a total of 14 GRAS notices had been submitted for 2’-FL as of December 31, 2025.

The first GRAS notification (GRN No. 571, 2015) covered microbial-derived 2’-FL with intended use limited to infant formula, at a maximum level of 2 g/L.

Subsequently, the intended uses expanded to a wide range of conventional foods. Among them, GRN No. 1051 includes the broadest application scope and higher use levels. Later approvals (GRN No. 1157 and 1238) follow similar conditions. Table 2 summarizes intended uses and maximum levels.

3-FL

As of December 31, 2025, a total of four 3-FL products have received FDA GRAS notifications, namely GRN No. 925, GRN No. 951, GRN No. 1037, and GRN No. 1099. With ongoing submissions, the intended uses of 3-FL have expanded from infant formula to multiple categories of general foods, as detailed in Table 3 below.

3’-SL

As of December 31, 2025, a total of six 3’-SL products have received FDA GRAS recognition, namely GRN No. 766, GRN No. 880, GRN No. 921, GRN No. 1015, GRN No. 1052, and GRN No. 1074. The intended uses and maximum use levels are shown in Table 4 below. Among them, GRN No. 1015 has no uses related to infant formula.

As of December 31, 2025, a total of five 6’-SL products have received FDA GRAS recognition, namely GRN No. 881, GRN No. 922, GRN No. 1016, GRN No. 1053, and GRN No. 1075. The intended uses and maximum use levels are shown in Table 5 below. Among them, GRN No. 1053 has the broadest intended uses.

As of December 31, 2025, a total of six LNnT products have received FDA GRAS recognition, namely GRN No. 547, GRN No. 659, GRN No. 895, GRN No. 919, GRN No. 1059, and GRN No. 1067. The intended uses and maximum use levels are shown in Table 7 below. Except for GRN No. 1059, the other five LNnT products have similar intended uses, with significant differences in maximum use levels in general foods, primarily reflecting higher usage levels. GRN No. 1059 has a distinct intended use, being applicable to exempt infant formula.

2’-FL/DFL

2’-FL/DFL was recognized as GRAS by the FDA on August 20, 2020. The intended uses and use levels are as follows:

As an ingredient in non-exempt infant formula for term infants, with a maximum use level of 1.6 g/L; In toddler formula and other toddler beverages (1–3 years), at 1.2 g/L; In other foods for infants and young children, at 10 g/kg; In conventional foods, beverages and beverage bases, cereal products, pasta, milk (whole and skim), and dairy products intended for the general population, at 2–40 g/kg.

LNFP-I/2’-FL

LNFP-I/2’-FL was recognized as GRAS by the FDA on January 19, 2023. The use levels follow the maximum use levels of LNFP-I, with specific ranges shown in Table 8.

It can be observed that multiple HMOs have already received GRAS notification in the United States. The intended uses of HMOs now include both infant and young child formula as well as a variety of conventional foods, with use levels higher than those in the initial submissions. When submitting for GRAS, companies may consider expanding the intended uses and expanded use levels, provided safety requirements are met.
