What Should Cosmetics Enterprises Do on May 1 2022?

Supplement Filing

  • For the cosmetics registered and filed on the old platform, the following documents shall be submitted through the new registration and filing platform:
  1. Product implementation standards
  2. Product label sample,
  3. Product formula (for domestic ordinary cosmetics)
  4. Upload label images of sales package (for special cosmetics)
  5. Supplement the product classification code

Summary of Basis of Efficacy Claims

  • For the cosmetics registered and filed during May 1 and Dec 31, 2021 on the new registration and filing platform

According to Standards for Evaluation of Cosmetics Efficacy Claims, efficacy claims of cosmetics shall be evaluated, and summary of basis of product efficacy claims shall be uploaded.

Exemption from Efficacy Evaluation

According to Standards for Evaluation of Cosmetics Efficacy Claims, not all cosmetics require evaluation of efficacy claims. The majority of efficacy claims for cosmetics on the market can be directly identified through the sensory recognition by the way of visual or olfactory system (i.e. cleaning, makeup removal, beauty and modification, fragrance, refreshing, hair dye, hair perm, hair color care, depilation, deodorization, auxiliary shaving or achieving effect through physical covering, adhesion, friction ) are exempt from efficacy evaluation;

Human Efficacy Evaluation

Human efficacy evaluation tests are required only for a small number of claims that have strong functions and are strictly regulated in most countries and regions as drugs or quais-drugs (i.e. anti-freckle and whitening, sunscreen, anti-hair loss, anti-acne, nourishment, repair and so on);

Other Efficacy Evaluation Methods

Other efficacy claims can be evaluated by means of literature research, research data analysis or laboratory test depending on the different scenarios.

Since 1st May 2022

Labeling

It shall comply with the provisions and requirements of Measures for Administration of Cosmetics Labeling. When applying for the registration and filing of Children's cosmetics, the "Little Gold Shield" has to be marked.

Main contents of Measures for Administration of Cosmetics Labeling:

  • The entity responsibility of cosmetics registrants and filers and the principle requirements of the content and form of cosmetics labels have been clarified.
  • Including the required labelling contents and the detailed requirements, and the forbidden contents on the label.
  • This new labelling regulation shall apply to the labels of cosmetics provided to consumers in the form of free trial, gift or exchange.
  • The main labelling requirements are indicated hereinafter:
    • Cosmetics should have Chinese labels.
    • The contents regarding the product safety and efficacy claims on the Chinese labels shall be consistent with the original labels in the case of Chinese sticker.
    • For products with packing boxes, the Chinese name and shelf life of the products shall also be marked on the packing containers that have direct contact with the contents.
    • All components not exceeding 0.1% (W/W) shall be labeled separately with ‘Other trace components’ as the lead.
    • It is prohibited to use medical terms, names of medical celebrities or names of drugs that express or imply that the products have medical effects.
