Analysis of Application Approval of New Food-Related Products (Food Contact Additives and Resins) in 2020

In 2020, the National Health Commission of the People's Republic of China (NHC) issued a total of 3 announcements on the form of "Three New Foods” (No. 4, 2020, No. 6, 2020, and No. 8, 2020). “Three New Foods” are new food raw materials, new food additives, and new food-related products (herein "new food contact additives and resins"). There were 80 “Three New Foods” products approved this year. Among them, there were a total of 46 new food contact additives and resins (including expanded use) approved.

Besides, from the website of NHC and China National Center for Food Safety Risk Assessment (CFSA), a total of 39 new food contact additives and resins application were officially accepted and 36 of public comments on food contact additives and resins (including expanded use) were issued for public comments.

1. List of new food contact additives and resins application acceptance in 2020 (39 types)

In 2020, NHC accepted the applications of 39 new food contact additives and resins, which include 18 of domestic products and 21 of overseas products. By the end of 2020, above one-third of the accepted products have passed the technical review of the Expert Review Committee from CFSA and have been open for public comments. Among them, 2 products have been formally approved.

In 2020, 36 of new food contact additives and resins have passed the technical review of the CFSA Expert Review Committee and have been open for public comments, including 7 of new food contact additives, 16 of expanded use of current food contact additives, 12 of new food contact resins, and 1 of expanded use of current food contact resin. Among them, all of the products (except for CAS No. 26589-46-8) issued on 18th February and 8th June were officially approved in the second half of this year.

Summary:

The application process of new food contact additives and resins must go through three important stages. Stage 1, NHC accepts the application. Stage 2, CFSA issues the public comments of the application. Stage 3, NHC approves the application. Generally, the application timeline is at least one year. Thus, if the application is accepted this year, the published comment will be issued at the end of this year or in the next year, and the application may be approved in the next year or the year after next year.

In order to implement the requirements of epidemic prevention and control, and ensure the smooth implementation of administrative licensing work, the way of online video evaluation and defense is adopted for the first time for CFSA and enterprises on new food-related products.

Compared to 2019, the number of accepted products (39 types) and the number of the products for public comment (36 types) are reduced, possibly due to the lower efficiency of dossier supplement resulting from the epidemic of COVID-19. Fortunately, however, the number of approved products in 2020 are more than the number of that in 2019, which are 46 and 40, respectively. Overall, the progress of acceptance and technical evaluation of new food-related products has not been significantly impacted by the epidemic.
