A Summary of Chinese Cosmetic Regulations in Force in 2022

The Measures for Supervision and Administration of Cosmetics Production and Operation officially implemented

  • New cosmetics production license and license change and renewal implemented according to the provisions.
  • Cosmetic registrants, the filers shall retain samples of each batch of products and record.
  • Concentrated cosmetics market operators, exhibition organizers should establish a file for the admissive cosmetics operators

  • When applying for registration and filing of cosmetics, safety information related to raw materials with the function of preservative, sunscreen, colorant, hair dyes, anti-freckle and whitening should be provided.
  • All ordinary cosmetics (including those filed cosmetics on the new and old registration and filing platforms) shall implement the annual report system uniformly. The filer shall submit the annual report of ordinary cosmetics that filing period has been over one year from January 1 to March 31 of each year through the new registration and filing platform.
  • When applying for the registration of cosmetics with the function of anti-freckle and whitening, hair loss prevention: registrants need to submit the qualified human efficacy evaluation report.

  • Evaluate the efficacy claims of cosmetics and upload a summary of the basis for product efficacy claims on a special website designated by the National Medical Products Administration (NMPA).

Regulations on the Supervision and Administration of Children's Cosmetics Come into Force

  • The management scope involves the definition, label, formula principle, safety assessment, sampling test, production and operation of children's cosmetics, and the children's toothpastes. The provisions on children's cosmetics other than labelling requirements come into force on January 1, 2022.

Measures for the Administration of Cosmetics Labels Come into Force

  • The entity responsibility of cosmetics registrants and filers and the principle requirements of the content and form of cosmetics labels are clarified
  • Including the required labelling contents and the detailed requirements, and the forbidden contents on the label.
  • These Measures shall apply to the labels of cosmetics provided to consumers in the form of free trial, gift or exchange.
  • The main labelling requirements are indicated hereinafter: cosmetics should have Chinese labels. The contents of product safety and efficacy claims on the Chinese labels shall be consistent with the original labels in the case of Chinese sticker. For products with packing boxes, the Chinese name and shelf life of the products shall also be marked on the packing containers that have direct contact with the contents. All components not exceeding 0.1% (W/W) shall be labeled separately with ‘Other trace components’ as the lead. It is prohibited to use medical terms, names of medical celebrities or names of drugs that express or imply that the products have medical effects.

Labelling requirements of the Regulations on Supervision and Administration of Children's Cosmetics

  • When applying for registration and filing of children's cosmetics, labels shall be marked as required.
